AUTHORIZATION PURSUANT TO PARAGRAPH 702.22(2)(a) OF THE CANADIAN AVIATION REGULATIONS

Pursuant to paragraph 702.22(2)(a) of the Canadian Aviation Regulations and after taking into account that the authorization is in the public interest and is not likely to affect aviation safety, I hereby authorize Omega Air Corporation, 4360 Agar Drive, Richmond, B.C., to operate an aircraft over a built-up area at altitudes and distances less than those specified in paragraph 602.14(2)(a), subject to the following conditions.

Paragraph 702.22(2)(a) states that for the purpose of subsection 602.15(2)(a) a person may operate an aircraft over a built-up area at altitudes and distances less than those specified in paragraph 602.14(2)(a), if the person has an authorization from the Minister or is authorized to do so in an air operator certificate.

Purpose

The purpose of this authorization is to allow Omega Air Corporation, 4360 Agar Drive, Richmond, B.C., to operate a helicopter at altitudes of less than 1000 feet above and less than 500 feet horizontal distance from the highest obstacle within the built-up area over a selected area of the West End, Vancouver, B.C.

Application

This authorization applies only to Omega Air Corporation, 4360 Agar Drive, Richmond, B.C., when operating for the purpose of the feature film production "Blade 3", over a selected area of the West End, Vancouver, B.C.

Conditions

This authorization is subject to the following conditions:

  1. These operations shall take place on Saturday, January 31, 2004; alternatively on Sunday, February 1, 2004, between the hours of 12:00 and 19:00 Pacific Standard Time (PST) depending on suitable weather conditions.

  2. Operations shall be conducted within the specified hours, under VFR conditions, using an AS355 type helicopter. The pilot shall be Mr. Jim Filippone, License No. CH259531.

  3. The site of the operations shall be as depicted on the maps submitted and held on file with Commercial and Business Aviation, Pacific Region; being as follows:
     

    Route 1: Approach from the North West direction at 600 feet Above Sea Level (ASL) with an ascent to the Wall Center Building from 600 feet ASL to 1200 ASL and terminating 200 feet horizontal from the Wall Center Building, Burrard Street at Nelson Street, Vancouver, BC

    Route 2: Approach from the North West direction at 800 feet ASL and descend to 600 feet ASL continuing on toward the Wall Center Building filming North East and terminating 200 feet horizontal from the Wall Center Building, Burrard Street at Nelson Street, Vancouver, B.C.

    Route 3: Filming of roof tops over the downtown core at 800 feet ASL, in an area bounded by Denman Street to the West, Main Street to the East, South to the North End of False Creek and North to Burrard Inlet.

    Route 4: Approach the Wall Center Building from the North West at 600 feet ASL and ascend to 1200 feet ASL and hover over the Wall Center Building at 1200 feet ASL (400 feet above the Rooftop) Burrard Street at Nelson Street Vancouver, B.C.
     

  4. The aircraft shall be flown in compliance within the "Height-Velocity" Diagram contained with the approved Aircraft Flight Manual.

  5. The aircraft shall conduct a power check immediately before commencing the operation, and the engines shall be at, or above, the manufacturers specifications.

  6. The aircraft shall be configured such that safe single engine fly away is assured at all times.

  7. The aircraft shall maintain a minimum horizontal clearance of 200 feet from the Wall Center Building at all times.

  8. The transit route to and from the route as under (c) above, shall be flown in accordance with Canadian Aviation Regulation 602.14, Minimum Altitude and Distances

  9. The altitudes for Route 1, Route 2, and Route 4 shall, at any time, not be less than 600 feet (ASL), or not below the rooftop of the former BC Hydro building, whichever is the highest.

  10. The altitude for Route 3 shall, at any time not be less than 800 feet ASL or not below the the roof top of the Wall Center Building. At no time shall the aircraft over fly St. Pauls Hospital.

  11. While hovering over the Wall Center Building the aircraft shall maintain a 100 foot vertical separation from the highest obstacle on the roof.

  12. The City of Vancouver and the City Police shall be informed of, and shall acknowledge the operation.

  13. All personnel involved shall be briefed on the operation, safety precautions and emergency procedures before flight operations commence.

  14. Persons carried on board the helicopter shall be limited to essential crew only.

  15. A copy of this authority shall be carried on board the aircraft while operating in Canada.

  16. The operation shall be coordinated with the appropriate Air Traffic Control authority;

  17. The aircraft shall comply with the Commercial Air Service Standards as required under CAR 702.22(2)(b).

Validity

The authorization is in effect until the earliest of the following:

  1. 19:00 hours PST, British Columbia, on Sunday, February 1, 2004;
  2. the date on which any of the conditions set out in this authorization is breached; or
  3. the date on which this authorization is cancelled, in writing, by the Minister, where he is of the opinion that it is no longer in the public interest, or that it is likely to affect aviation safety.
